Applicable Laws

These terms will in all respects be governed and construed in accordance with the laws of South Africa. The user submits to the non-exclusive jurisdiction of the Courts of South Africa.

Waiver

Failure or neglect by us to enforce at any time these terms, will not be construed as a waiver of our rights, nor will such failure or neglect in anyway effect the validity of the whole or any part of these terms, nor prejudice our rights to take subsequent action.

Entire Agreement

These terms constitute the entire agreement between the parties in respect of this subject matter. As far as the law of South Africa allow, we will not be bound by any express or implied representation, term, warranty, promise or the likes that are not recorded in this agreement.

Terminology

“The author” refers to Neil Bierbaum. “The coach” refers to Neil Bierbaum and/or one appointed by him as a subcontractor.

Coaching Services

The scope, themes, forms and intentions of the coach’s services are visible in the brochures he has presented and are known to the client.

Copyright

The client acknowledges the copyright of the coach. Reproductions in any form must have written permission from him.

Confidentiality

The coach recognizes that the client may have future plans, business affairs, customer lists, financial information, job information, goals, personal information, and other private information. The coach will not at any time, either directly or indirectly, voluntarily use any information for the coach’s own benefit, or disclosure, or communicate this information to a third party

Ethics

The coach acknowledges and commits to the Code of Ethics as outlined by the International Coaching Federation. The coach does not represent any religious ideology, and is not a member of any sect, cult or dogmatic organization.

The Client’s Responsibility

The client has been made aware that the coach is in no way to be construed as providing psychotherapy, psychological counseling, or any other type of therapy. The client constitutes that they do not take psychopharmacological drugs, illegal drugs and that they are not receiving psychotherapeutic treatment. If so, they are to inform the coach immediately. For travel arrangements, flight fares, hotel reservations etc, the client is solely responsible.

Quality Guarantee

The satisfaction of clients is the coach’s highest priority. To provide the best coaching skills is the coach’s commitment. It is the coach’s philosophy to do whatever it takes in order for the client to achieve their goals in the most effective way. The coach gives his word that the client will realize the goals they have set and that he will provide active and complete participation.

Billing

The billing of the delivered coaching services will be executed according to the terms expressed in the Proposal form. The billing is done via this website, or by email, when agreed by both parties. The payment of the bill is expected as per the terms specified on the invoice.

Extra Charges

There are no extra charges relating to travel expenses for the coach in your nearby area. When coaching is delivered by telephone or online medium, the client will contact the coach at the prearranged time. The client is aware that sessions postponed or cancelled within 24 hours will be charged for and the session will be regarded has having been taken or used.

Liability

The client is fully responsible for himself/herself and his/her actions within and outside of the coaching relationship. He/she is liable for possible damages if incurred. The coach is released from any liability claims, except if these are based on intentional harmful behavior of the coach.

Cancellations by the Coach

The coach asks you for your understanding that he reserves the right to cancel coaching sessions, for example in the case of illness. However, he shall in every case inform the client before the scheduled session.

Salvatorian Clause

In the case that one or more of these terms become disempowered, the other terms shall not be impacted by that. The coach and the client shall agree upon a substitute term, which comes closest to the discontinued term.

Court of Jurisdiction

Disputes arising from or in connection with this agreement shall be finally resolved in Cape Town in accordance with the Rules of Arbitration Foundation of Southern Africa by an arbitrator appointed by the aforesaid foundation as soon as reasonably practical in the circumstances with a view to it being completed within 30 days after it is demanded in writing.

Returns

Obviously, we will refund you if you can show that the book was physically defective before it was shipped, for example if there are pages missing or blank.

We will not be held liable if a physical product like a book does not arrive, and we can show that we have used a reputable service, and prove that we shipped it.

In the unlikely event that you do not receive that value that you feel you deserve, or that is promised, you are invited to submit a complaint. Please contact us and state where you believe the product you bought and used didn’t measure up.

Your complaint will be treated with the respect it deserves and we will do our best to resolve it.

This last point applies to Google, mostly, although they’ve said they’re going to do less of that.

As you can see, the Personal Information that we collect is used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy.
